The Texas seat belt statute

Like every state except for New Hampshire, Texas has a law on the books requiring the use of safety restraints for people riding in motor vehicles. In this case, the relevant law is Sec. 545.413 of the Transportation Code, which details the circumstances in which seat belt use is required and the fines for not doing so. Under section A of this statute, it is illegal for anyone, adult or child, to ride in the front seat of a vehicle that has seat belts without having their seat belt properly fastened. Section B states that it is illegal for anyone under the age of 17 to ride in any part of a motor vehicle without a seat belt if the vehicle is equipped with them.

I don’t have any idea what the fine will be. If it’s much of a fine, I intend to fight the ticket.
Don’t bother. Without a doctor’s certification, you don’t have a leg to stand on.

Arizona

When you wear a seatbelt, this will allow you to receive full compensation in the event someone causes a serious injury to you in an auto accident in which you were not at fault. In Arizona, even if someone admits they were completely at fault for an accident, and that person admits that his or her negligence caused the accident, this negligent driver can get away with paying nothing or next to nothing.
We know that if the negligent party’s defense can show that the injured person would have eliminated or decreased the possibility of injury by wearing a seat belt, this could definitely happen in an Arizona courtroom. The degree to which the seatbelt would have prevented injury will lessen any compensation the injured party gets, even if the liable driver admits fault. In Arizona, the injured party would then get stuck with medical expenses, as well as losing out on lost income and other compensable claims for damages.
Consider too the medical expenses that are often associated with the injuries that result from a serious accident in which no seatbelt was worn. It has been reported that over half of all bankruptcies in the United States come about as a result of medical bills. So if you do not care about your physical health when it comes to wearing seatbelts, think about your financial health.

 

 

Ok well here’s the thing about the seatbelt.

1. It’s a 3 point seatbelt. So it has a shoulder strap.
2. Unless she had a doctor’s note saying she can’t or shouldn’t use the shoulder strap  She was in the wrong. If she did buckled up with the 3 point seat belt, she would have to be wearing it properly.She said only the belt?So she put the shoulder harness behind her back?
